Terms of Service

By accessing dreamyarddigital.com or engaging Dreamyard LLC for services, you agree to these Terms of Service. If you do not agree, please do not use our website or services. These terms apply to all visitors, clients, and anyone who submits an inquiry or enters into a service agreement with Dreamyard LLC.

Dreamyard LLC provides digital marketing and creative services including, but not limited to:

• Paid advertising management (Meta, Google, and other platforms)
• Social media management and content creation
• Web design and development
• Brand strategy and creative direction
• AI automation and custom workflow development
• Website maintenance and SEO

The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate written agreement or proposal provided to the client prior to the start of work.

To receive services, clients agree to:

• Provide accurate business information, credentials, and access needed to perform the work
• Respond to requests for feedback, approvals, or content within a reasonable timeframe
• Pay invoices on time as outlined in the service agreement
• Ensure that any content, trademarks, or materials they provide do not infringe on third-party rights

Payment terms, rates, and billing schedules are specified in the individual service agreement. Unless otherwise agreed in writing:

• Monthly retainers are billed at the start of each month
• Project work may require a deposit prior to the start of work
• Late payments may result in a pause in services

Ad spend for paid advertising campaigns is billed separately and is the client’s responsibility. Dreamyard LLC does not front ad spend on behalf of clients.

Services are provided on a month-to-month basis unless a fixed-term agreement is in place. Either party may end the engagement with 30 days’ written notice. Upon termination:

• Dreamyard LLC will complete or hand off any in-progress work at its discretion
• Outstanding balances are due and payable immediately
• Access to client accounts and credentials will be returned or revoked as appropriate

Dreamyard LLC commits to delivering professional, high-quality work. However, we do not guarantee specific results such as a defined number of leads, a specific return on ad spend, or particular search rankings. Marketing outcomes depend on many factors outside our control, including market conditions, client responsiveness, ad platform policies, and audience behavior.

Upon full payment, clients own the final deliverables created specifically for their brand (website designs, ad creatives, branded content). Dreamyard LLC retains ownership of any proprietary tools, templates, systems, or frameworks developed independently and used in the delivery of services. We may use completed work in our portfolio and marketing materials unless the client requests otherwise in writing.

Both parties agree to keep confidential any non-public business information shared during the engagement. This includes ad account data, business financials, internal strategies, and client lists. This obligation survives termination of the service agreement.

Dreamyard LLC’s total liability for any claim arising out of or related to services shall not exceed the total fees paid by the client in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or lost data.

These Terms are governed by the laws of the State of Tennessee. Any disputes will be resolved in the courts of Nashville, TN.
